Judge rules for Gibson Electric in ownership suit

DYERSBURG, Tenn. (AP) — A group that tried to take control of a West Tennessee power distributor has ended its appeal of a court ruling that went against it.

Circuit Court Judge Clayburn Peebles had ruled in November that the group that amended the Gibson Electric Membership Corporation's charter, adopted new bylaws and tried to take control of the distributor in 2007 had no power and any actions it took were void.

The State Gazette in Dyersburg reported Peebles entered his final order last month. It ordered one of the defendants in a lawsuit by the co-op — Ricky G. Smith of Union City — to pay $40,000 in damages.




Gibson Electric wins court battle over ownership

A group claiming ownership of Gibson Electric Membership Corporation lost a legal battle.


The group amended the utility's charter, adopted new bylaws and took steps to take control of the corporation in 2007. GEMC countered, filing a complaint first in Davidson County Chancery Court and later in Gibson County Circuit Court.


Gibson County Circuit Judge Clayburn Peeples determined that the group has "no power, right or authority to take any action on GEMC's behalf, and any and all actions that the (group has) previously taken or attempted to take on behalf of GEMC are null and void."


In a judgment filed last month, Peeples also ordered one of the defendants - Ricky G. Smith of Union City - to pay the utility $40,000 in damages.
